Favy is provided by mehrbytes GbR, Mika Jens Ramsl und Mats Ramsl, An der Ehmsenkoppel 28, 24376 Rabel, Germany. Contact: favy@mehrbytes.com. These Terms govern the Favy app and favy.mehrbytes.com when validly agreed with you. Mandatory consumer rights remain unaffected.
02What Favy offers
Favy is a food discovery and personal rating app. Features include saving dishes and restaurants, photos and notes, personal ratings and rankings, maps, lists, shared collections, following friends, a recommendation feed, a Food Passport, profiles, and supported home-screen widgets. Available features depend on your app version, device, permissions, and plan.
Reviews reflect individual opinions. Restaurant details, locations, prices, opening hours, and third-party information may be incomplete or outdated. Confirm important information with the restaurant. Favy does not verify allergens, ingredients, food hygiene, or suitability for dietary or medical needs; ask the restaurant directly before relying on such information.
03Eligibility and account security
Favy is intended for people aged 16 or older. If you cannot enter into a binding contract under the laws that apply to you, you must have the necessary permission from your legal guardian. Provide accurate account information, protect your login credentials, and inform us of suspected unauthorized access. You are not responsible for unauthorized activity to the extent that applicable law provides otherwise.
05Your content and rights
You retain ownership of the rights you hold in your photos, reviews, notes, and other contributions. You must own the content or hold the permissions needed to upload it and grant the licences below. Respect copyright, privacy, rights to one’s image, and other third-party rights. Do not upload copied photos or identifiable people without the required permission.
Your reviews must reflect genuine experiences and distinguish opinion from factual claims. Do not submit unlawful, defamatory, discriminatory, harassing, fraudulent, or misleading content, fake ratings, undisclosed paid endorsements, spam, or other people’s confidential information.
06Licence needed to operate Favy
For content you upload, you grant us a non-exclusive, worldwide licence to store, reproduce, technically adapt, and display it as necessary to provide the features you request, including hosting, resizing photos, synchronization, sharing, maps, feeds, and widgets. This licence follows your visibility settings and permits our technical service providers to act for us only to deliver these functions.
The service licence ends when content is deleted, except for temporary technical copies awaiting deletion, continuing uses you have separately authorized, and retention required by law. It does not grant ownership of your content or allow us to turn private entries into advertisements.
07Permission to use public content in Favy marketing
For reviews, ratings, and associated photos that you knowingly publish as public after agreeing to this clearly disclosed clause, you grant us an additional non-exclusive, worldwide, royalty-free licence to reproduce, display, distribute, and communicate that public content solely to promote Favy. This includes the Favy website, app-store listings, Favy’s social-media accounts, digital advertisements, email campaigns sent lawfully, and printed promotional material. Mandatory remuneration rights remain unaffected.
We may crop, resize, translate, or excerpt content for those formats without materially distorting your opinion or creating a misleading endorsement. Limited sublicensing to production agencies, hosting providers, and advertising platforms is permitted only as necessary to deliver Favy’s own promotional material. This does not permit sale of your photos as stock images or advertising unrelated products.
Private content and restricted shared-list contributions are excluded. Copyright remains with you. No blanket surrender of copyright, moral rights, personality rights, or data protection rights is required. Promotional use of your identity, profile photo, recognizable likeness, or other personal data requires a separate voluntary permission where applicable; public posting alone is not that consent. We do not assume that you can authorize the likeness or other rights of a person shown in a photo.
You can end this promotional licence for future use by making the content private, deleting it, or contacting favy@mehrbytes.com. We stop new uses and remove the affected material from channels under our control without undue delay, normally within 30 days. Already distributed printed material and independent third-party copies may not be retrievable; statutory removal, objection, and erasure rights remain unaffected. Backup copies may remain solely for legal or technical retention and are not available for new campaigns.
This clause is not retroactive: older content requires an applicable prior permission or a fresh agreement before promotional reuse. The separate consent rules in our Privacy Policy also apply.
08Acceptable use and content reports
Do not compromise security, impersonate others, manipulate ratings, gain unauthorized access, or scrape personal information. Do not interfere with the service or infringe the rights of users, restaurants, or other people. Statutory rights relating to interoperability, lawful research, and permitted uses of software remain unaffected.
To report illegal content or a rights infringement, send the specific content link or identifying details, your reasons, relevant evidence, and a way to contact you to favy@mehrbytes.com. We assess reports and may restrict visibility, remove content, or suspend accounts when justified. Where required, we explain the reason and provide a way to contest the decision. Contact support if you think a decision was mistaken.
09Paid features and subscriptions
The app may offer paid features, subscriptions, or one-time purchases. The price, included features, billing period, trial conditions, and renewal terms shown before purchase govern the offer. Apple or Google handles store purchases. RevenueCat helps manage purchase status and entitlements.
Subscriptions renew where specified in the purchase flow unless cancelled through the relevant store in time. Uninstalling Favy or deleting your account does not cancel a subscription. You can manage or cancel it in the store account used for purchase. Restore purchases using the supported in-app option if access is missing.
Refunds for store purchases can be requested through the relevant store. Statutory remedies, withdrawal rights, and claims against the legally responsible trader remain unaffected. A statutory withdrawal right for digital content expires only when the legal requirements, including any necessary express consent and acknowledgement, are met; these Terms alone do not waive it.
10Availability and changes
Some features need internet access, device permissions, or third-party services. We provide Favy with reasonable care but cannot promise uninterrupted access or compatibility with every device. This does not limit statutory conformity, update, or warranty obligations.
Necessary security and compatibility updates may be required. Material changes to contracted digital services are made only where permitted by applicable law, for valid reasons such as security, legal requirements, or technical compatibility, and with required notice and consumer remedies. Price changes apply in accordance with your contract, store rules, and mandatory law.
11Rights in the app and store terms
Except for your content and third-party material, rights in the app, its software, branding, and design remain with us or the relevant rights holders. You receive a limited, non-exclusive licence to use the app on compatible devices under these Terms and the applicable store usage rules. Statutory software-use rights remain unaffected.
For Apple downloads, Apple’s Standard End User License Agreement applies unless a valid custom EULA is supplied through the App Store. Apple’s and Google’s applicable store terms also govern their own services. These Terms do not create obligations for a store provider beyond its applicable agreement or the law.
12Liability
We are liable without limitation for intent and gross negligence, injury to life, body, or health caused by our fault, fraud, guarantees we expressly assume, and mandatory statutory liability, including under applicable product liability law.
For other damage caused by ordinary negligence, we are liable where an essential contractual obligation is breached, limited to the foreseeable damage typical of the contract. An essential obligation is one whose performance makes the contract possible and on which you may ordinarily rely. Otherwise, liability for ordinary negligence is excluded to the extent permitted by law. These limitations do not restrict mandatory consumer rights.
13Account closure and termination
You may stop using Favy and request account deletion through settings or support. We may restrict or terminate access for a material breach or other legally justified reason, applying proportionate measures and notice where required. Any rights to refunds or remedies for a paid service remain unaffected. Content licences and retention after deletion are governed by the specific provisions above, not by an unlimited right to retain or reuse your data.
14Privacy
Our Privacy Policy explains how Favy processes account information, uploaded content, contacts, location, analytics, and purchase data. Accepting these Terms is not blanket consent to tracking or marketing.
15Changes, applicable law, and contact
We inform you of significant changes to these Terms. Where agreement is legally required, we obtain it; silence or continued use is not automatically treated as agreement to a new marketing licence or a material change.
German law applies, without depriving consumers of mandatory protection under the law of their habitual residence. Statutory jurisdiction rules apply. For questions, contact favy@mehrbytes.com.
